אין כאן אף דוגמה לקבוצה שהתחילה בליגה נמוכה יותר. כל הדוגמאות פה הן לקבוצות שעברו לזהות משפטית חדשה אבל המשיכו באותה ליגה. בחלק מהמקרים זה מצוין במפורש כאחת מהסיבות להחלטה לראות בהן כאותה ישות מבחינת פיפ"א.
ככל שידוע לי, קרה רק פעם אחת בתולדות הספורט האירופאי - במקרה של בולוניה סל (התאגיד המקורי פורק והם השתלטו על קבוצה אחרת בליגה נמוכה יותר, כמו הפועל סל) לצערי, מטעמי חסיון, לא יכול לשתף את פסק הבוררות.
זה בהחלט יכול לקרות, אגב, לפי פסיקות ה-CAS, אלא שהסיכויים לכך נמוכים.
מה לך ולבולוניה סל? מעניין.

The rationale of Article 3-300 of the FIBA Internal Regulations is to avoid a scenario
where a club “disappears” and is subsequently “reborn” with a different legal hat, thus
trying to avoid having to pay debts. The reason why the provision gives large discretion
to FIBA is to be able to respond to the creativity of club managers and/or advisers in
attempting to structure a “rebirth” with a clean balance sheet. Pursuant to Article 3-300 of
the FIBA Internal Regulations it is irrelevant whether under the applicable civil law a
“succession” in the technical sense takes place, as long as the new club is linked to the old
club and by virtue of this link significantly benefits, in whatever form, from achievements
of the previous entity, in sporting terms and/or financially.
